By visiting our website or entering into a project agreement with us, you confirm that you have read, understood, and agreed to the terms stated below. If you do not agree with these terms, please refrain from using our services or accessing our website.

1. General Work Terms & Client Responsibilities

• All website content, including text, images, and multimedia, must be provided by the client before the project begins. The accuracy and copyright ownership of the provided materials are the client’s responsibility.
• Clients are responsible for maintaining a full backup of their existing website and data before Creative Dream Designs & Brands begins work. We are not liable for any loss or damage to existing data under any circumstances.
• Unless specifically mentioned in the contract, Creative Dream Designs & Brands is not responsible for tasks such as hosting, domain registration, data entry, or third-party licensing.
• Any images, designs, or content created by Creative Dream Designs & Brands remain our intellectual property until full payment is made or unless otherwise agreed in writing.
• While we strive to meet deadlines, project timelines may be adjusted due to unforeseen issues such as third-party dependencies, communication delays, resource unavailability, or technical bottlenecks.
• Clients will be provided with an opportunity to review the design and functionality of the project during and after completion. If no feedback is received within 7 days, the work will be considered approved.

2. Content Ownership & Copyrights

• Clients retain ownership of their original content, logo, and materials provided to us.
• The client guarantees that all submitted materials are free from third-party copyrights. The client shall indemnify and hold Creative Dream Designs & Brands harmless from any legal claims arising from copyright violations.
• Creative Dream Designs & Brands reserves the right to showcase completed work (including designs and websites) in its portfolio or marketing materials unless the client requests otherwise in writing before project completion.

3. Payments

• We accept payments through bank transfer, online payment gateways, or other approved methods.
• Project work will begin only after receiving the initial deposit (usually 30–50% of the total project cost).
• The remaining balance must be paid upon project completion before website launch/ project handover or final file delivery.
• In case of project cancellation by the client, a cancellation fee will be charged based on the percentage of work completed.
• Non-payment or overdue amounts may result in project suspension or legal action if necessary.

4. Revisions, Add-ons, and Change Requests

• Any new features or modifications requested after project approval will be considered additional work and will be billed separately.
• Changes made after design approval or moving to the next development phase will incur additional costs.
• Time and pricing adjustments will apply to scope changes, added functionalities, or new integrations requested by the client.

5. Limitation of Liability

• Creative Dream Designs & Brands shall exercise reasonable skill and care in delivering services but makes no guarantees on performance, uptime, or results influenced by third-party systems or tools.
• We are not liable for:
  • Loss or corruption of data due to client actions or third-party interference.
  • Downtime or disruptions caused by external hosting providers or network issues.
  • Any indirect, incidental, or consequential losses, including profit or reputation damage.
• Except in cases of gross negligence or intentional misconduct, Creative Dream Designs & Brands’ total liability shall not exceed the total amount paid by the client for the project.

6. Approvals and Delivery

• The project will progress through multiple stages, with each stage commencing only after approval and payment for the previous one.
• Once final approval is received, the website or project files will be deployed to the client’s server.
• All source code, files, and materials will be transferred only after full payment has been received.
• Creative Dream Designs & Brands reserves the right to delay project delivery in case of pending payments or incomplete content submissions from the client.

7. Timelines

• The agreed project timeline begins after receiving both the initial payment and all required project materials.
• Delays in client communication, feedback, or resource submission may result in project timeline extensions.
• We strive to meet all deadlines; however, we shall not be held responsible for delays beyond our control (e.g., third-party server issues, unexpected technical challenges, or client-side delays).

8. Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of the United Arab Emirates.
Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of the UAE.

9. Severability

If any part of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full effect. The invalid portion will be replaced with a valid clause that best represents the original intent.

10. Acceptance of Terms

By engaging with Creative Dream Designs & Brands, submitting a project brief, or making a payment, the client confirms acceptance of these Terms and Conditions.
